By accessing or using Faarli (hereafter “the Service”), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

1. Definitions

  • Service: The software-as-a-service platform provided by Faarli...
  • User / Subscriber: Any individual or legal entity registering for or using the Service.
  • Account: Your unique access credentials (email/password or OAuth login).
  • Content: Any data, information, or materials uploaded, submitted, or created by the User.

2. Eligibility

  • Be at least 18 years old.
  • Have legal capacity under Moroccan law to enter into binding contracts.
  • Comply with all applicable local laws and regulations.

3. Account Registration

  • Users must provide accurate and up-to-date information.
  • Account credentials are personal and non-transferable.
  • Users are responsible for maintaining the confidentiality of their credentials and for all activities under their account.
  • Faarli is not liable for any unauthorized access resulting from account misuse.

4. Subscription and Payment

  • The Service is offered on a subscription basis, with fees and billing cycles displayed on the platform.
  • All payments are in [MAD / other currency] and are non-refundable unless required by Moroccan consumer law.
  • By subscribing, you authorize automatic payment collection for recurring subscriptions.
  • Failure to pay may result in suspension or termination of your account.
  • Taxes applicable under Moroccan law are the responsibility of the User.

5. Free Trials (if applicable)

  • Free trials are limited to one per user.
  • Upon trial expiration, the account will be automatically converted to a paid subscription unless canceled.

6. User Conduct

Users must not:

  • Violate Moroccan laws or regulations.
  • Access, interfere with, or damage the Service or its infrastructure.
  • Distribute malware, spam, or harmful content.
  • Violate intellectual property rights or privacy of others.
  • Attempt to bypass security or restrictions of the Service.

Violation may result in immediate account suspension or termination without refund.

7. Content Ownership and License

  • Users retain ownership of their Content.
  • By using the Service, Users grant Faarli a limited license to use, store, and process Content as necessary to provide the Service.
  • Faarli is not responsible for Content loss, unauthorized access, or third-party use.

8. Intellectual Property

  • The Service and all associated intellectual property are owned by Faarli or its licensors.
  • Users may not copy, reproduce, distribute, or create derivative works of the Service without written permission.

9. Privacy and Data Protection

  • Faarli collects and processes personal data according to the "Privacy Policy".
  • Users consent to storage and processing of data on servers located in Morocco or internationally.
  • Users have the right to access, correct, or request deletion of their personal data, in accordance with Moroccan law.

10. Termination

  • Users may terminate their subscription at any time through their account.
  • Faarli may suspend or terminate accounts for violations of these Terms or for non-payment.
  • Upon termination, access to Content may be revoked. Users are responsible for backing up their data.

11. Disclaimer and Limitation of Liability

  • The Service is provided "as is" and "as available."
  • Faarli does not guarantee uninterrupted, error-free, or secure operation.
  • Liability for any indirect, incidental, or consequential damages is excluded to the maximum extent permitted by Moroccan law.
  • Total liability is limited to the amount paid by the User for the last 3 months of Service.

12. Modifications to the Service or Terms

  • Faarli may modify the Service or these Terms at any time.
  • Users will be notified of significant changes. Continued use of the Service constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

  • These Terms are governed by Moroccan law.
  • Any disputes shall be resolved amicably; if not possible, they will be subject to the jurisdiction of courts in Casablanca, Morocco.
